Seine Rede „The Trial of Jean Peltier for Libel against Napoleon Buonaparte“ (1803) wurde von Mme de Staël-Holstein ins Französische übersetzt. Seit 1804 war Mackintosh als Stadtrichter Bombays und Richter des Marineministeriums tätig. Nach seiner Rückkehr nach England 1812 trat er in das Parlament ein. Hier setzte er sich erfolgreich für die Überarbeitung des Strafrechts ein. Mackintosh unterrichtete später Jura und Politik am East India College in Haileybury.
